Fair Use Policy (FUP) for Network Resources

This document establishes the principles of fair use (Fair Use Policy, "FUP") of network resources and forms an integral part of the Public Offer concluded between the Client and INTEZIO WORLDWIDE LIMITED (the "Contractor"). The purpose of this Policy is to ensure stability, performance, and fair distribution of shared hosting resources (VDS/VPS) by preventing excessive, continuous, or malicious bandwidth utilization by individual Clients.

1. General provisions

1.1. Priority of the Offer

  • This FUP applies together with the Public Offer. In case of conflict, provisions that ensure maximum protection of infrastructure and network stability shall prevail.

1.2. Scope

  • This Policy applies to network traffic, port utilization, disk operations (IOPS), CPU and RAM usage, network behavior, and any actions affecting infrastructure security.

1.3. Monitoring

  • The Contractor performs automated and manual monitoring of technical service parameters. Internal monitoring data is considered sufficient evidence of FUP violations.
  • Monitoring does not include analysis of user data content except where required by law.

2. Internet traffic usage

2.1. Dedicated servers

  • Unlimited traffic is provided without volume-based charging (TB).
  • Unlimited traffic does not exempt the Client from channel utilization limits and other FUP requirements.

2.2. Virtual servers (VPS/VDS)

  • Monthly traffic limits are set by tariff plans:
  • BASIC-1 — 3 TB, BASIC-2 — 6 TB, BASIC-3 — 12 TB, BASIC-4 — 18 TB, BASIC-5 — 30 TB, BASIC-6 — 50 TB, BASIC-7 — 60 TB, BASIC-8 — 70 TB
  • PROMO-1 — 2 TB, PROMO-2 — 3 TB, PROMO-3 — 5 TB
  • EE-1 — 6 TB, EE-2 — 12 TB, EE-3 — 24 TB, EE-4 — 36 TB, EE-5 — 60 TB, EE-6 — 100 TB, EE-7 — 120 TB, EE-8 — 140 TB

2.3. Traffic accounting

  • The billing period is one calendar month. Counters reset on day 1 of each month at 00:00 (UTC+3).
  • If limits are exceeded, the Contractor may limit speed, issue additional billing, or temporarily suspend service.

3. Channel utilization limits

3.1. Unfair use definition

  • Continuous excessive port utilization is considered unfair use.
  • A violation occurs when utilization exceeds the allowed threshold for 12 consecutive hours in any billing period.

3.2. Utilization thresholds

  • PROMO (up to 100 Mbps): 60%
  • BASIC (up to 1 Gbps): 30%

3.3. Special rule for EE plans (Estonia)

  • For EE servers, utilization must not exceed 10% of maximum port speed for 12 consecutive hours.
  • Exceeding this threshold is a violation regardless of total traffic volume.

4. Enforcement measures

4.1. Speed limiting (shaping)

  • Speed may be limited to 10 Mbps (ingress and egress) without prior notice.

4.2. Notification

  • The Client is notified via ticket system within a reasonable time.

4.3. Restriction duration

  • The restriction remains in effect until the end of the current paid period unless otherwise agreed.

4.4. Repeated violations

  • In case of repeated violations during two consecutive billing periods, the Contractor may refuse renewal, terminate the agreement unilaterally, and discontinue service without refund.

5. Speed restoration and further use

5.1. Restoration condition

  • The Client may restore full port speed before period end only by switching to a plan billed by actual consumption (for example, 95th percentile billing).

5.2. Refusal to switch

  • If the Client refuses to switch, 10 Mbps speed limitation remains until the current paid period ends.
  • Using Services with limited speed is not grounds for recalculation or refund.

5.3. Service renewal

  • Upon renewal for the next period, full speed is restored.
  • The Contractor reserves the right to charge additional fee for potential network risk or require migration to 95th percentile billing as a mandatory condition.

5.4. Repeated violations

  • For repeated violations across two billing periods, the Contractor may refuse renewal and terminate the agreement without refund.

6. Disk usage (IOPS)

  • 6.1. VPS infrastructure is shared. Excessive disk load is prohibited.
  • 6.2. Stress testing affecting other clients is prohibited.
  • 6.3. The Contractor may apply IOPS limitations without prior notice.

7. CPU and RAM usage

  • 7.1. In virtual environments, resources are allocated dynamically.
  • 7.2. Sustained 100% CPU load over long periods is prohibited.
  • 7.3. Processes bypassing fair resource allocation are prohibited.
  • 7.4. Measures may include resource limitation, temporary suspension, or termination.

8. Prohibited activity

  • 8.1. Participation in DDoS attacks, botnet operations, phishing, mass spam, malware distribution, unauthorized scanning, and any activity threatening infrastructure is strictly prohibited.
  • 8.2. The Contractor may immediately suspend service in case of infrastructure or third-party risk.

9. Policy changes

  • 9.1. The Contractor may amend this FUP at any time.
  • 9.2. Continued use of Services after publication of a new version constitutes acceptance of updated terms.

10. Final provisions

  • 10.1. Any activity creating infrastructure risk may be limited regardless of traffic volume.
  • 10.2. Contractor decisions based on technical monitoring data are deemed justified and sufficient.
  • 10.3. Using Services constitutes full acceptance of this Policy.
